Last Will & Testament
A will is a written document that speaks for you after you die. It communicates how you want your property and assets to be distributed by your executor. It names a guardian for your minor children; in case you pass away before they reach adulthood. It also leaves other specific instructions, like preferred arrangements for your pets or funeral. Anyone who has children, property, and/or assets should have a will. And, even if you do not have children or a lot of savings or property, a will is still important as it has more than one purpose.
Powers of Attorney
A power of attorney is a legal document that gives someone you trust the right to make financial or health care decisions for you. That person does not need to be a lawyer. Usually, you appoint someone under a Power of Attorney because you want them to make decisions for you in case you are unable to make your own decisions because you are not mentally capable.
A will expresses your wishes for after you die and has no legal effect before you die. A Power of Attorney only has effect before you die. People often make a will and Powers of Attorney at the same time to prepare for both contingencies.

Probate
Probate is the legal process of submitting a deceased’s will to the court to be proved. The court then confirms the validity of the will and the appointment of the executor. In case there is no will, the probate process will result in the appointment of a person with the authority to function as the estate trustee.
